Welcome to True North Market. These Terms of Use (“Terms”) govern your access to and use of our website, storefront, products, and related services (collectively, the “Services”). By browsing, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Services. We may update these Terms periodically; the “Last updated” date will reflect changes. Continued use after updates means you accept the revised Terms, except where additional consent is required by law.

1. Who we are

True North Market is a curated online marketplace offering jewelry and selected lifestyle goods from brands we feature (including RHYMEE TU and other partners). Product pages, collections, and brand stories describe offerings available through our storefront.

2. Eligibility and accounts

• You must be at least 18 years old (or the age of majority where you live) to place an order or create an account.
• You are responsible for accurate registration information and for keeping login credentials confidential.
• Some checkout flows require sign-in through iGNITE Connect. Your use of iGNITE is also subject to iGNITE’s applicable terms and privacy notices.
• We may suspend or terminate accounts that violate these Terms, appear fraudulent, or pose a security risk.

3. The Services

We provide an online catalog, product information, shopping cart, wishlist, checkout, order tracking communications, and customer support. We may change, suspend, or discontinue any part of the Services (including products, pricing, or features) at any time. We are not liable for unavailability caused by maintenance, outages, or events beyond our reasonable control.

4. Products, descriptions, and natural variation

• We aim for accurate descriptions, photos, and pricing. Natural stone, pearls, plating, and handmade or small-batch pieces may vary slightly in color, texture, inclusions, size, or finish. Such natural variation is not a defect.
• Product images are illustrative; on-screen colors may differ from physical products depending on your display.
• Personalized or made-to-order items (including letter/initial options) are produced according to the variant you select at checkout. Please review options carefully before paying.
• We reserve the right to limit quantities, refuse orders, or cancel orders that appear to be placed in error or in bad faith.

5. Pricing, currency, and taxes

• Prices are displayed in Hong Kong Dollars (HKD) unless otherwise stated. Currency conversion tools on the site, if any, are approximate for convenience only; you are charged in the currency processed at checkout.
• Prices may change at any time before you complete payment. Promotional codes are subject to their stated conditions and may be withdrawn.
• Applicable taxes, duties, or fees (if any) will be shown where required. You are responsible for any additional charges imposed by your bank or payment provider.

6. Orders and payment

• An order offer is made when you submit checkout. Acceptance occurs when payment is successfully authorized and we send an order confirmation email (or equivalent notice).
• Payment is processed securely by Stripe. By paying, you also agree to Stripe’s applicable terms.
• We may reject or cancel an order (and refund you) if payment fails, stock is unavailable, pricing or description errors occur, fraud is suspected, or delivery cannot be completed to the address provided.
• Pre-order or made-to-order items ship according to timelines stated on the product page; those timelines are estimates unless we expressly guarantee a date.

7. Shipping and delivery

• We currently offer local Hong Kong delivery only, unless we expressly announce otherwise.
• Shipping rates, methods, and estimated timelines are described on /shipping and at checkout. Risk of loss passes according to the carrier’s rules and applicable law once the order is delivered or as otherwise required.
• You are responsible for providing a complete and accurate delivery address and for being available to receive the parcel. Failed delivery attempts may incur additional fees or return-to-sender handling.
• International shipping is not available at this time unless we state otherwise on a product or during checkout.

8. Returns, refunds, and final sale

• Our return policy is set out on /returns. In summary, eligible unworn items in original packaging may be returned within the stated window, unless a collection or product is marked final sale or otherwise excluded (for example personalized jewelry or opened hydration goods).
• Final-sale collections or items identified as non-returnable on the product, collection, or returns page cannot be returned or exchanged except where mandatory consumer law requires otherwise.
• To start a return, contact us with your order number. Refunds, when approved, are issued to the original payment method within the timeframe described on /returns after we receive and inspect the return.
• Chargebacks filed without first contacting us may delay resolution; please allow us a reasonable opportunity to help.

9. Promotions and gift cards

Promotions, discounts, and any gift-card or store-credit programs are subject to specific rules published with the offer. We may cancel abuse of promotions (including stacking prohibited codes or automated purchasing).

10. Intellectual property

• All storefront content — including text, layout, graphics, logos, product photography we own or license, and software — is owned by True North Market or our licensors and protected by intellectual property laws.
• You may view and use the site for personal, non-commercial shopping only. You may not copy, scrape, crawl in an abusive manner, reverse engineer, resell, or commercially exploit our content or catalog without prior written permission.
• Brand names and product designs belonging to featured makers (for example RHYMEE TU) remain their property.

11. Acceptable use

You agree not to:

• use the Services for unlawful, fraudulent, or harmful purposes;
• interfere with site security, other users’ accounts, or our infrastructure;
• upload malware or attempt unauthorized access;
• harvest personal data of other users;
• misuse promotional systems or payment methods;
• post or transmit unlawful, defamatory, or infringing content through contact or review features.

We may investigate violations and cooperate with law enforcement.

12. Third-party services

Checkout, authentication, analytics, and shipping rely on third parties (including Stripe and iGNITE Connect). Those services are governed by their own terms. We are not responsible for third-party outages or policies outside our reasonable control, except to the extent required by law.

13. Disclaimers

The Services and products are provided on an “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, except for warranties that cannot be excluded under Hong Kong law or other mandatory consumer protections.

Nothing in these Terms limits rights you have as a consumer that cannot be waived by contract.

14. Limitation of liability

To the fullest extent permitted by law, True North Market and its affiliates, officers, and suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services or any product.

Our total liability for any claim arising out of these Terms or an order will not exceed the amount you paid to us for the order giving rise to the claim (or, if no order, HKD 500), except where liability cannot be limited by law (including for death or personal injury caused by negligence, or fraud).

15. Indemnity

You agree to indemnify and hold harmless True North Market from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, violation of these Terms, or infringement of others’ rights — except to the extent caused by our willful misconduct or as prohibited by law.

16. Governing law and disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules that would require another jurisdiction’s law.

Courts of Hong Kong shall have exclusive jurisdiction over disputes arising from these Terms or the Services, subject to any mandatory rights you have to bring claims in your place of residence under consumer protection law.

17. General

• If any provision is held unenforceable, the remaining provisions continue in effect.
• Our failure to enforce a provision is not a waiver.
• These Terms, together with the Privacy Policy, Shipping and Returns pages, and any order-specific terms displayed at checkout, form the entire agreement between you and us regarding the Services.
• You may not assign your rights under these Terms without our consent; we may assign them in connection with a reorganization or sale of assets.
